Items manufactured by EarHugger Safety Products, Inc. (“Our Company” or “EarHugger”) are guaranteed to work for either ninety (90) days or one year from date of purchase.
This Warranty remains in force for a period of ninety (90) days or one year from the original date of purchase (the “Warranty Period”). The warranty duration varies depending on the item purchased.
This Warranty covers the original purchaser of the product during the Warranty Period. This Warranty is not transferrable.
This Warranty covers defects in materials and workmanship as well as damage to the product occurring in normal course. This Warranty does not cover damage due to negligence, misuse or abuse of the Product.
Within the Warranty Period, Our Company will at its sole option (1) repair or replace the damaged or defective Product using new or refurbished parts or Product up to 3 times within the Warranty Period, (2) provide a prorated credit toward the purchase of a like replacement product.
Our Company shall not be liable for any incidental or consequential damages for breach of any express or implied warranty on the product nor shall recovery of any kind against Our Company be greater than the purchase price of the Product.
Except to the extent prohibited by applicable law, any implied warranty of merchantability or fitness for a particular purpose on the product is limited in duration to the duration of this Warranty. All implied warranties, including the implied warranties of merchantability and fitness for a particular purpose are excluded and disclaimed.
Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to the Purchaser.
State Law—This Warranty is governed by the laws of the State of Utah, USA.
This Limited Warranty gives the purchaser specific legal rights. The Purchaser may have other rights which vary from state to state.
No Earhugger reseller, agent or employee is authorized to make any modification, extension or addition to this warranty.
